Your access to and use of this website, as well as all related websites operated by Being Here Now, LLC dba/ Authentic Masculinity Project (which includes www.beingherenow.com, authenticmasculinityproject.com, hardcorechallenge.com, dopamanreset.com, AMP, East Texas Stress Reduction Clinic, ETSRC, among others) (collectively the “Site”) is subject to the following terms and conditions (“Terms of Use”) and all applicable laws. By accessing and browsing the Site, you accept, without limitation or qualification, the Terms of Use and acknowledge that any other agreements between you and the Site are superseded and of no force or effect.

1. CONTENT AND INTELLECTUAL PROPERTY

You agree that the Site itself, as well as all content, videos, training materials, products, services and/or other materials, made available on the Site by us or other third parties, as well as the look and feel of all of the foregoing, (collectively referred to as the “Content”) are maintained for your personal use and information by Being Here Now, LLC dba/ Authentic Masculinity Project (the “Company”) and are the property of the Company and/or its third party providers. You agree that such Company Content shall include all proprietary videos, HTML/CSS, Javascript, graphics, voice, and sound recordings, artwork, photos, documents, and text as well as all other materials included in the Site, including all accompanying downloadable documentation such as assessments, tracking PDFs, and related materials, excluding only the materials you provide. Subject to your compliance with these Terms of Use, the Company hereby grants you a limited license, which is non-exclusive, non-transferable, and non-sublicensable, to access, view, and use the Site solely for your personal purposes.

2. PURCHASES, PROGRAMS, AND GROUPS

2.1 Digital Products and Courses

The Company offers digital products, courses, and programs (e.g., the Hardcore Challenge) available for purchase as single, one-time payments or payment plans. By purchasing a digital product or course, you are granted a limited, non-exclusive, non-transferable license to access the content for your personal use.

2.2 Group Programs and Communities

The Company may offer group coaching programs, challenges, or private communities (such as Facebook groups or private forums). Participation in these groups is subject to the specific terms outlined at the time of enrollment. The Company reserves the right to remove any participant from a group program or community at any time, without refund, if the participant violates community guidelines, breaches confidentiality, or engages in disruptive behavior.

2.3 Billing, Payments, and Refunds

  • One-Time Purchases: Payment is due in full at the time of purchase unless a specific payment plan is offered and selected.
  • Payment Plans: If you select a payment plan, you are financially responsible for completing all scheduled payments, regardless of your completion of or continued access to the program.
  • Refund Policy: All sales are final and non-refundable unless a specific money-back guarantee or refund policy is explicitly stated on the sales page for that specific product or program at the time of purchase.

3. COACHING SERVICES DISCLAIMER

3.1 Nature of Services

IMPORTANT: The coaching, mentoring, and consulting services provided by the Company, AMP Certified Coaches, and Scott Austin Martin are NOT licensed therapy, counseling, or medical treatment. These services are educational and developmental in nature.

3.2 Professional Boundaries

  • Scott Austin Martin is a Licensed Professional Counselor (LPC) in the state of Texas; however, NO THERAPEUTIC RELATIONSHIP is established through AMP programs, digital products, groups, or coaching services.
  • AMP services are EDUCATIONAL AND COACHING SERVICES ONLY.
  • If you require therapeutic intervention, you are encouraged to seek appropriate licensed mental health services in your jurisdiction.

3.3 Scope of Practice

  • AMP coaching focuses on personal development, goal achievement, and authentic masculinity principles.
  • Services do not include diagnosis, treatment, or cure of any mental health condition.
  • Participants are responsible for their own mental health and well-being.

4. CONFIDENTIALITY AND PRIVACY OF PARTICIPANTS

4.1 Participant Confidentiality

The Company maintains strict confidentiality regarding:

  • Participant identities and participation in groups or programs.
  • Personal information shared in coaching sessions or private groups.
  • Individual participant progress and challenges.

4.2 Group Confidentiality Agreement

By participating in AMP communities, group programs, or challenges, you agree to:

  • Maintain absolute confidentiality regarding other participants’ identities and shared information.
  • Not record, screenshot, or share content from private groups, Zoom calls, or coaching sessions.
  • Respect the privacy of all community members.
  • Report any breaches of confidentiality to Company administrators immediately.

4.3 Breach of Confidentiality

Violation of confidentiality agreements will result in:

  • Immediate termination from all programs and communities.
  • Forfeiture of all program access without refund.
  • Potential legal action for damages.

5. LIABILITY WAIVERS AND ASSUMPTION OF RISK

5.1 Assumption of Risk

By purchasing or participating in AMP products or programs, you acknowledge and assume the following risks:

  • Emotional discomfort that may arise from personal development work.
  • Relationship changes that may result from personal growth.
  • Financial responsibility for your business and life decisions.
  • Physical and emotional well-being during intensive personal work.

5.2 Release of Liability

You hereby release, waive, discharge, and covenant not to sue the Company, Scott Austin Martin, AMP Certified Coaches, and all affiliated parties from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to:

  • Any loss, damage, or injury that may be sustained by you.
  • Any emotional, psychological, or relationship consequences.
  • Any business or financial decisions made based on program content.
  • Any actions taken or not taken as a result of program participation.

5.3 Indemnification

You agree to indemnify and hold harmless the Company and all affiliated parties from any claims, damages, or expenses arising from:

  • Your participation in programs or communities.
  • Your breach of these Terms of Use.
  • Your violation of any law or third-party rights.
  • Your conduct in connection with the Site or services.

6. NO GUARANTEES OR WARRANTIES

6.1 Results Disclaimer

THE COMPANY MAKES NO GUARANTEES, WARRANTIES, OR REPRESENTATIONS REGARDING:

  • Personal transformation or growth outcomes.
  • Relationship improvements or changes.
  • Financial or business success.
  • Resolution of personal challenges.
  • Specific results from program participation or product use.

6.2 Individual Responsibility

Your results depend entirely on:

  • Your commitment to the work.
  • Your execution of program principles.
  • Your personal circumstances and history.
  • Your willingness to change and grow.
  • Factors outside the Company’s control.

7. THIRD-PARTY SERVICES AND PLATFORMS

The Company utilizes various third-party services including but not limited to:

  • Kajabi, LLC – Course hosting and platform
  • ClickFunnels – Sales funnels and landing pages
  • BookFunnel – Digital book and eBook delivery
  • Facebook/Meta – Community groups and live sessions
  • Zoom – Video conferencing for live sessions
  • Stripe – Payment processing
  • Email service providers – Communication and marketing

Your use of these services is also governed by their respective terms of service and privacy policies. The Company is not responsible for the availability, accuracy, or practices of any third-party platform.

8. COPYRIGHT PROTECTION AND PROHIBITED USE

8.1 Ownership of Materials

All content made available through the Company’s websites, programs, digital products, courses, books, eBooks, videos, audio recordings, worksheets, PDFs, scripts, frameworks, methodologies, and any other materials (collectively, “Company Materials”) are the exclusive intellectual property of Being Here Now, LLC dba/ Authentic Masculinity Project and are protected under United States copyright law (17 U.S.C. § 101 et seq.) and applicable international copyright treaties.

8.2 Prohibited Uses

You are strictly prohibited from doing any of the following without prior written permission from the Company:

  • Copying, reproducing, republishing, uploading, posting, transmitting, or distributing any Company Materials in any form.
  • Presenting, selling, or representing any Company Materials — in whole or in part — as your own original work.
  • Using Company Materials to create derivative works, courses, programs, or products for commercial or personal gain.
  • Sharing login credentials or granting unauthorized access to any purchased program or digital product.
  • Downloading, screenshotting, or recording any video, audio, or live session content for redistribution.
  • Translating, adapting, or modifying any Company Materials without express written authorization.

8.3 Enforcement

The Company actively monitors for unauthorized use and reproduction of its materials. Any individual or entity found to be in violation of these copyright protections may be subject to immediate removal from all programs and communities, forfeiture of access without refund, a formal DMCA takedown notice, and civil legal action seeking actual damages, statutory damages up to $150,000 per work under 17 U.S.C. § 504, injunctive relief, and recovery of attorney’s fees and costs.

8.4 DMCA Notice

If you believe that any content on the Site infringes upon your copyright, please send a written notice to info@beingherenow.com with the subject line “DMCA Notice” including a description of the copyrighted work, the URL of the allegedly infringing content, and your contact information.

10. LIMITATION OF LIABILITY

IN NO EVENT SHALL THE COMPANY BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, PUNITIVE, RELIANCE OR CONSEQUENTIAL DAMAGES, WHETHER FORESEEABLE OR NOT, INCLUDING, BUT NOT LIMITED TO, DAMAGE OR LOSS OF PROPERTY, EQUIPMENT, INFORMATION OR DATA, LOSS OF PROFITS, REVENUE OR GOODWILL, COST OF CAPITAL, COST OF REPLACEMENT SERVICES, OR CLAIMS FOR SERVICE INTERRUPTIONS OR TRANSMISSION PROBLEMS.

11. GOVERNING LAW AND JURISDICTION

This agreement shall be governed by and construed in accordance with the laws of the State of Texas. You further submit to the exclusive jurisdiction of the state and federal courts sitting in Smith County, Texas.

12. SEVERABILITY

If any provision of this agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions.

13. MODIFICATIONS

These Terms of Use may be revised from time to time by updating this posting. You are bound by any such revisions and should therefore periodically visit this page to review the then current Terms of Use to which you are bound.
